1. PURCHASE CONDITIONS OF PRODUCTS OFFERED ON THE WEBSITE

1.1. General conditions

Signing up in Quirumed.com is free. The clients will have access to their personal data through a password and they can change their data at any time. The clients are not obliged to sign up and can unsubscribe whenever they want. The information we receive when a sign up is carried out is completely confidential and only Quirumed S.L.U. will have access to the data.

1.2. Pre-contracting information

These general conditions of contract, together -where appropriate- with the particular conditions that may be established, will expressly regulate the relations arising between QUIRUMED S.L.U. with registered office at Carrer del corretger 117, Parque Empresarial Táctica, 46980 Paterna (Valencia - Spain), and the Users who contract the products offered through the website.

The User/Buyer could access the information on the products in several languages.

These General Conditions have been drawn up in accordance with the provisions of Spanish law: Law 34/2002 on Information Society and Electronic Commerce Services, Law 7/1998 on General Terms of Contract, Royal Decree 1906/1999 regulating telephone or electronic contracting with general conditions in development of Article 5.3 of Law 7/1998, General Law 26/1984 for the Protection of Consumers and Users, Law 7/1996 on the Organisation of the Retail Trade, Royal Decree-Law 14/1999 regulating the Electronic Signature and any other legal provisions that may be applicable.

The use and/or acquisition of any product of the website implies acceptance as a User, without reservations of any kind, of each and every one of these General Conditions, as well as of the Specific Conditions that, where applicable, govern the acquisition.

QUIRUMED S.L.U. informs that the procedures to carry out the purchase of products are those described in these General Conditions, as well as those specific ones that are indicated on the screen during navigation, so that the User acknowledges having read and accepts these procedures as necessary to access the products and services offered on the website. Any modification and/or correction of the data provided by the Users during navigation will be possible and must be made according to the indications included in the website.

The products offered in the website, together with their features and price, will appear on the screen. We try to show as accurately as possible the colour of our products, but it should be taken into account that the quality, configuration and resolution of the computer display may alter the perception of the colours, so there may be some slight difference in colour between the real product and the one shown on the screen. QUIRUMED S.L.U. does not guarantees that the shown colour is an exact reproduction of the final product the User receives. QUIRUMED S.L.U. reserves the right to decide at any time the products contained and offered in the website to the Users. Thus, QUIRUMED S.L.U. may at any time add new products to those included in the website, it being understood, unless otherwise provided, that such new products shall be governed by the provisions of the General Conditions in force at that time. Also, QUIRUMED S.L.U. reserves the right to stop providing access, at any time and without prior notice, to any of the products offered on the website.

1.3. Procedure of products purchasing

To purchase products offered on the website, QUIRUMED S.L.U. will request the Users to proceed to sign up, for which such Users, who must be of legal age (18 or over years old), must complete the instructions that appear on the screen and that will require the execution of the following instructions, as well as any others that may be included in the different screens of the Web page: (I) full completion of the electronic application form that at any time appears on the website, following the instructions it indicates; (II) clicking the icon “ACCEPT”; (III) receiving in the user’s e-mail the conformity of the registration.

The login and password provided by the User to QUIRUMED S.L.U. are identifying and enabling components to access and make the purchases, and they are personal and non-transferrable. The login cannot be modified by the User; but the password can, in which case the modified keys will lose their validity.

Once the User has registered, and to proceed to the purchase of the products, he or she must choose the category of products, then add the product he or she wishes to purchase in the 'Shopping Cart', according to the indications on the screen, filling in the order form supplied for this purpose and sending it to QUIRUMED S.L.U., which implies the irrevocable reading and acceptance of each and every one of these General Conditions, as well as, where applicable, of the existing Specific Conditions. The purchase will be understood to be made at the address of QUIRUMED S.L.U. unless otherwise provided by law.

Once the purchase has been made and in the shortest term possible, QUIRUMED S.L.U. will send by e-mail to the User/Buyer a proof of purchase. Likewise, the User/Buyer can apply for, and QUIRUMED S.L.U. will provide, the corresponding invoice. The order confirmation and the proof of purchase will not have validity as an invoice.

QUIRUMED S.L.U. reserves the right to cancel the login and password, and therefore, the access to the website of those Users, whether Individuals, Companies or Suppliers, that have debits or non-payments with QUIRUMED S.L.U.

1.4. How to carry out an order

You can make your orders through the following means:

1.5. Shipping fees

You may consult the fees by adding the products to the shopping cart and selecting the destination area.

The transport fee depends on the volume of the products, the weight and the delivery zone.

The price of transporting large volume goods such as electric tables, beds, showcases, etc. does not include the service of climbing stairs, the carrier will leave the goods at street level. We have the option of an additional service for the ascent to the door of the residence, you may hire it through the contact form on the website. If the delivery street is pedestrian, you must hire a special service. The price of the products does not include installation or assembly. Make sure the product fits the elevator or stairwell. If the additional transport service has not been hired, the User/Buyer will be responsible for uploading the package to the desired location by his or her own means.

For areas outside EU, customs charges at destination and taxes in the area are not included. In the case of shipments of orders from Spain to the UK, the applicable incoterm will be DDP (Delivery Duty Paid).

IMPORTANT: In the event that, at the time of delivery by the carrier, the goods are found to be defective or visibly damaged, this should be noted on the carrier's delivery note and we would ask you to notify us within 24 hours of receipt of the order by contacting the QUIRUMED S.L.U. after-sales service department. In any case, you should always check that the goods have been delivered in perfect condition and it is recommended that you always write "DAMAGED PACKAGING" or similar on the carrier's delivery note in order to be able to make a claim at a later date, otherwise the carrier will consider the reception of the product to have been accepted or REJECT THE GOODS (if the damage cannot be marked) by contacting the QUIRUMED S.L.U. after-sales service department.

1.6. Deadlines

*For DISCONTINUED products in stock, the deadline may vary between 8 and 16 weeks. Consult the deadline in the contact form.

If you need the material urgently, consult the deadline via e-mail or by filling in the contact form.

The delivery time may vary due to manufacturing or import matters.

Due to having over 10.000 different references among all of our products, selected in different countries and areas worldwide, it is not possible to have stock for each one of the references.

*The products indicated as IN STOCK are available in our warehouses permanently (barring exceptional circumstances).

Delivery times in working days, except for transport problems outside of Quirumed, are as follows:

NOTE: Quirumed will put a lot of effort to respect these terms, but its delays, due to transporting problems outside the company, will not imply the cancellation of the order nor any kind of compensation.

1.7. Delivery of the products

IMPORTANT: In the event that it is found, upon receiving the goods from the transport agency that the packaging of the item/items of the order is/are visibly damaged, you must state this and write it on the delivery note of the transport company when signing for the the order.

From there, you need notify us within 24 hours of the delivery by contacting the after-sales service department at Quirumed S.L.U. In all cases, you must always check that the goods have been delivered in perfect condition and if you have doubts, it is recommended that you always put "DAMAGED PACKAGING" or similar on the delivery note so that it can be claimed back later, as if not the transport company will consider that the item has been delivered in perfect condition. Please, do not throw away the packaging.

QUIRUMED S.L.U. won't take responsibility for any reports of damage during transport if the cliente does not make a note of damage on the delivery note of the transport company and it won´t be possible for us to re-emburse or offer compensation for the cost of the damage to the product nor will the client have the right to make a claim against Quirumed.

1.8. Customs information

When making an order to Quirumed to be delivered in a country or area that does not belong to the European Union, it is possible that the recipient has to give import rights and taxes when arriving to its destination. This is due to the recipient of the order turns into the importer of the goods, therefore he or she should comply with all the laws and regulations applicable in such country or area. In the case of shipments of orders from Spain to the UK, the applicable incoterm will be DDP (Delivery Duty Paid).

Any extra expense to the payment of customs laws and/or dues is responsibility of the recipient. Quirumed does not have control on such expenses, therefore it is not possible to anticipate their cost. Since the customs policy vary significantly from one country to another, we recommend you to contact the corresponding customs office to obtain more information on the import restrictions applicable to specific products.

The customs offices of some countries require to the importer of record that provides some kind of identification before proceeding with an order’s despatch. As importer of record, you could be requested, either to you or to the person you are addressing the delivery, to provide a personal identification numbe.

Quirumed will not take responsibility for any customs charges that need to paid by the customer. If the client refuses to pay the corresponding import taxes, the goods shall be held in custody in the corresponding customs. No refunds accepted.

1.9. Price and payment method

The purchase prices in force at the time the order is placed are those shown on the screen. The prices indicate the Value-Added Tax (VAT). In the event of a typographical error, we will contact the client as soon as possible to provide a solution.

However, purchases made by residents of non-EU countries will be exempt from VAT and subject to the payment of the corresponding import tax (customs clearance costs and import taxes are not included in the price of the article or in the shipping price and must be paid at destination by the User).

In the case of shipments of orders from Spain to the UK, the applicable incoterm will be DDP (Delivery Duty Paid).

In general, any taxes, duties, fees and brokerage service fees that may result from the purchase of products, as well as any other expenses derived from them, will be at the end User's expense.

The delivery costs that appear on the screen will be at the User's expense and will correspond to the rates set by the transport agency contracted at any given time, and will depend on the destination and weight of the shipment.

Our prices will be displayed in EUROS however, the user may change the currency on the website to their chosen currency. This price then displayed on the website when the currency is changed over, has it´s conversion rate calculated by the European Central Bank who send us a daily conversion rate between euros and the chosen currency. If you go onto the webpage with an IP address from a country outside of Spain, then the currency displayed may be changed over automatically to the local currency. Please note that we charge in EUROS. The final invoice will always be sent in EUROS.

All methods of payment offered on the website are for payment in advance.

As soon as the User adds a product to the 'Shopping Cart' in the description on the screen, the amount of the product will appear with and without VAT or, if the purchase is exempt from this tax, this exemption will be automatically considered based on the personal data entered by the User, once the latter has confirmed his or her order. The payment of the price of the products purchased and the shipping costs, which will appear on the screen, can be made either by credit or debit card, bank transfer or PayPal. To proceed with the payment, the User must follow every one of the instructions that appear on the screen, providing the following information: if the payment has been made by credit or debit card: a) type of card; b) card number; c) expiration date; d) as well as any other information required by the screen.

As an electronic payment system QUIRUMED S.L.U. has installed an e-commerce payment gateway that you have contracted with the bank. All data provided for this purpose are encrypted to ensure maximum security.

The navigation and purchase process on the web is carried out using the SSL protocol, thus providing both the client and Quirumed S.L.U. with the highest standards of confidentiality and security in communications.

This protocol is universally supported by all major browsers and guarantees the User (I) the identity of the recipient of his or her data (not impersonation by the seller), (II) the confidentiality of the information provided by the vendor and (III) the integrity (non-infringement) of the information provided by the vendor.

Also, QUIRUMED S.L.U. states that under no circumstances does it store in any way the data provided by Users through the payment gateway, and that they are only kept while the purchase is made, the payment is made and until the withdrawal period has elapsed. In order to provide greater security for credit card owners, a three-digit number has been included on their cards to serve as an identification code to verify the physical presence of the card during online transactions. This three-digit number is printed on the back of your card (in the signature area) immediately after the card number. In order to prevent fraudulent credit card transactions, such check digits will be requested to validate the transaction.

Any exchange or bank charges that are charged to convert the local currency into EUROS are to be borne by the client. Please note that the conversion rate charge that the customers bank may charge, may vary in relation to the currency exchange rate that we have displayed on our webpage.

In the event that the User / Buyer pays for their order via a bank transfer in a currency other than EURO, the refund payment will be made in EUROS.

  • Payment with credit card - only through the website
  • Payment through PayPal, it is a payment system with credit card or PayPal account. Only through the website. (If you choose the Paypal payment method, it will not be possible to change the delivery address of the order according to PayPal restrictions).
  • National and international bank transfer
  • Consult other special conditions, only for public organisations and large companies

NOTE: It is very important for transfers or payments that in the SENDER or PAYER field, that you indicate the name of the end client and in the SUBJECT, you must indicate the order number, quote number or invoice number.

B. Invoices

The invoice will be processed once we have the confirmtion that the order has been delivered. Approximately 24 hours after the invoice has been processed, it will be available to download via the customer account.If you wish to modify ANY DATA from it you must communicate it to us WITHIN 3 DAYS maximum through our contact form, selecting the option modify invoice and detailing the changes required.

1.10. Returns policy

The client shall have a maximum period of fourteen (14) calendar days from the day of the delivery of the Product to cancel, or part cancel, the purchase of the Product or products, in accordance with the applicable law. To exercise this right please click here.

Once the period of fourteen (14) calendar days has passed, QUIRUMED S.L.U. will not accept refunds for the withdrawal of the products purchased.

The Client shall not have the right to return the product established by the applicable laws and, in particular, including but not limited to, in the following cases: (i) Products made according to the Client's specifications or that are clearly personalised; (ii) For reasons of hygiene and health, QUIRUMED S.L.U. restricts the returns of hygiene products, products that may come into contact with the skin,(iii) Food products only in the case that they have been unsealed after delivery. Likewise, the return of any software for sale in our catalogue will not be accepted if the installation or activation of the same or the packaging, seal or seal has been opened or manipulated. This is due to the characteristics of this type of product that requires a license, registration or activation. Under these mentioned circumstances the return of the products or products will not be accepted.

According to Art. 16 of Directive 2011/83 / EU, the supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery will loose the right to be returned.

In it´s Article 47, this Directive indicates that to determine the nature, the characteristics and operation of the goods, the consumer should only carry out these manipulations and inspections of the goods as those that would be admitted to a commercial establishment. During the trial period, the consumer must handle and inspect the goods with due care.

A trial period is 14 days as indicated in the first paragraph of this section.

In cases of the cancellation of orders that are "under order" QUIRUMED S.L.U. reserves the right to charge between 20% and 50% of the amount of the product for the expenses.

The procedure to excercie the right of a refund will begin with the Client's request by opening up a request through the After-Sales Department form that appears on the website, and then sending it to QUIRUMED S.L.U upon confirmation that the return request has been accepted. The After-Sales Department will reply within a maximum of 48 hours from receipt of the request, assigning return instructions if accepted.

Once the Client has received the return number, they must return the product within fourteen (14) days from the date of notification of the reqeust to Quirumed, by sending us back the product (indicating the assigned return number on the package) to the following address: Carrer del corretger 117, Parque Empresarial Táctica, 46980 Paterna (Valencia - Spain).

To return an order from a country or territory not belonging to the European Union, the customer must bear the costs of customs duties / taxes in order to release the goods when they arrive to Spain. Quirumed has no control over such expenses and therefore it is not possible to anticipate their amount. Since customs policies vary significantly from one country to another, we advise that the customer contact the corresponding customs office for information on this. This amount will be deducted from the total refunded.

Quirumed is not responsible for customs withholding goods. In the event that the customer refuses to pay the corresponding customs charges, the merchandise will be retained in their respective customs.

QUIRUMED S.L.U. will check at its warehouse the status of the returned Product, reserving the right to refuse to make a refund in the event of detecting that the Product purchased is not received in perfect condition. If it is not received in its original packaging, this will result in a refund with a reduce amount from the original value of the product.

QUIRUMED S.L.U. will manage the return of the price and delivery costs using the same payment system used by the Client for the purchase of the products. No additional costs will be refunded for standard delivery charges, such as express, priority or courier service. Payments shall be made in EUROS.

1.11. Communications between the parties - Customer Service

For the purposes of these General Conditions, and for any communication that may be required between QUIRUMED S.L.U. and the User, these must be addressed to the Customer Service Department using the contact form that appears on our website or by written communication addressed to the Customer Service Department of QUIRUMED S.L.U. located at Carrer del corretger 117, Parque Empresarial Táctica, 46980 Paterna (Valencia - Spain).

The communications of QUIRUMED S.L.U. to the User will be made according to the data provided by the User when signing up on the website. The User expressly accepts for all communications related to the use of the website, and/or the purchase of products, the use of electronic mail as a valid procedure for sending such communications.

1.12. Applicable law and jurisdiction

These General Conditions, as well as the Specific Conditions that, when appropriate, are established, will be interpreted and governed by the Spanish laws. In case of controversy, it will be resolved by the competent courts. Also, as an entity adhered to CONFIANZA ONLINE and under the terms of its Code of Ethics, in case of disputes relating to recruitment and online advertising, data protection and child protection, the consumer and / or user may go to the system of extrajudicial dispute resolution of CONFIANZA ONLINE.

1.13. Warranty

The warranty of the product /products sold by QUIRUMED S.L.U. is provided and established by virtue of the regulations contained in the legislation in force, in particular, in the aforementioned Royal Decree 1/2007, article 114 et seq., a legal framework that aims to provide the consumer with different options for requiring remediation when the goods purchased are not in conformity with the contract, giving him or her the option of requiring repair or replacement of the goods, unless one of these is impossible or disproportionate. Where repair or replacement is not possible or would be disproportionate, the client may demand a reduction in the price or termination of the contract.

In case of non-conformity of the product, a period of three (3) years for individual consumers and a period of one (1) year for companies professionals and freelancers, valid from the date of the delivery of the product, for the buyer to be able to access their rights. However, only within two (2) years of delivery will it be presumed that the lack of conformity already existed at the time of delivery, and it will be for the buyer to prove that the goods were not in conformity, in accordance with article 114 et seq. of the Royal Decree 1/2007. The consumer must inform QUIRUMED S.L.U. of the lack of conformity within two (2) months of becoming aware of it.

After two (2) years from the invoice date, the equipment for repair must be sent at the client's expense. QUIRUMED, S.L.U. reserves the right to check that the defect has been caused by manufacturing failure or misuse. If the product is under warranty, QUIRUMED S.L.U. shall pay the client the postage paid and the return to the client shall be the responsibility of QUIRUMED S.L.U. If the product is not under warranty, the client shall have to collect the product at his or her own expense. Consumable parts such as batteries, hydraulics, motors, cables, batteries, light bulbs, fuses, electronics, wheels, etc. are not covered by the warranty along with other types of accessories.

During the period of repair or revision, the company will not replace the product and will not imply any compensation.

QUIRUMED S.L.U. reserves the right to request an official technical service of the trademark, a verification of the source of the problem. In the event of a defect caused by misuse, the repair will be chargeable.

To make use of the warranty, it is necessary to notify our after-sales department. For any goods that have not been previously authorised for exchange, return or repair will not be accepted in our warehouses. See instructions in section 5.

The warranty is only valid to the holder (contractual party) who appears on the invoice and only the holder can demand it.

The warranty will lose its value:

  • In case of misuse due to failure to follow the product instruction manual.
  • If any of the information on the purchase receipt or the proof of purchase is modified, altered or replaced.
  • If the device itself is tampered with or repaired without the knowledge of our Aftersales Department.
  • When there is no invoice.
  • In case of power surges or connection to an unsuitable voltage.

1.14. Order’s cancellation

The cancellation of an order processed by the client, in the process of manufacture or import, will cover all costs such as transport, customs charges, etc. Quirumed will not be responsible is a manufacturer discontinues a product, and will not imply any compensation.
